Terms & Conditions

1.1. Eligibility: You must be at least 18 years old and capable of forming a binding contract under the laws of Ghana to use the Service.
1.2. License to Use: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal and non-commercial purposes, subject to these Terms.

 

3. Service Provider Listings and Relationship

3.1. Directory Nature: Pets Ghana acts solely as an introductory directory to connect Pet Owners and Service Providers. We are not an agent, employer, partner, or joint venturer of any Service Provider.
3.2. No Endorsement or Guarantee: Pets Ghana does not endorse, recommend, or guarantee the Service Providers, their services, qualifications, licenses, insurance, or performance. We do not verify all credentials and are not responsible for the accuracy of listing content.
3.3. Provider Responsibility: Service Providers are solely responsible for:
* The accuracy and completeness of their listing information.
* Maintaining all necessary licenses, permits, insurance, and professional qualifications required by Ghanaian law.
* The quality, safety, and legality of the services they provide to Pet Owners.
3.4. Limitation of Liability (Provider-User Transactions): Pets Ghana is expressly not liable for any damages, injury, loss, or expense arising from or in connection with any service rendered, or any conduct, misrepresentation, or omission by any Service Provider or Pet Owner. Any dispute regarding the services provided is strictly between the Pet Owner and the Service Provider.

 

4. Paid Services for Service Providers

4.1. Fees and Payment: Access to certain enhanced listing features (“Paid Services”) requires payment of the applicable fees (e.g., subscription, listing fee). All fees are clearly stated at the point of purchase.
4.2. Automatic Renewal (if applicable): Paid Services may be subject to automatic renewal. You authorize Pets Ghana to charge your payment method on file for the renewal term unless you cancel your subscription before the renewal date.
4.3. No Refunds: All payments for Paid Services are non-refundable, except as explicitly required by Ghanaian consumer protection laws or at the sole discretion of Pets Ghana.

 

5. User Content and Community Guidelines

5.1. Responsibility for Content: You are solely responsible for all User Content you submit. You represent and warrant that your User Content is accurate, not confidential, and does not violate any third-party rights (including copyright, privacy, and proprietary rights).
5.2. License to Pets Ghana: By submitting User Content, you grant Pets Ghana a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content on the Service and across any media.
5.3. Reviews and Ratings: Pet Owners may post reviews. Pets Ghana reserves the right, but not the obligation, to moderate, edit, or remove any User Content, including reviews, that it deems inappropriate, defamatory, abusive, fraudulent, or in violation of these Terms.
5.4. Prohibited Content: You agree not to post, upload, or transmit any User Content that is unlawful, harmful, defamatory, obscene, harassing, racially or ethnically offensive, or promotes illegal activity.

 

6. Intellectual Property

6.1. Pets Ghana IP: All content on the Service (excluding User Content), including text, graphics, logos, software, and the compilation thereof, is the exclusive property of Pets Ghana or its content suppliers and is protected by Ghanaian and international intellectual property laws.
6.2. Restrictions: You may not copy, reproduce, republish, download, post, transmit, or distribute any material from the Website without our prior written consent.

 

7. Disclaimers and Limitation of Liability

7.1. “AS IS” Basis: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Pets Ghana makes no warranties, expressed or implied, regarding the Service, including, without limitation, non-infringement, merchantability, or fitness for a particular purpose.
7.2. Limitation of Liability: To the maximum extent permitted by law, Pets Ghana, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) any Service Provider’s failure to provide services or compliance with any law.
7.3. Maximum Liability: In no event shall the aggregate liability of Pets Ghana for all claims relating to the Service exceed the amount you paid to Pets Ghana, if any, for the Paid Services in the preceding six (6) months.

 

8. Governing Law and Jurisdiction

8.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles.
8.2. Dispute Resolution: Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts located in Accra, Ghana.

 

9. Changes to Terms

Pets Ghana reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will notify you of material changes by posting the new Terms on the Website and updating the “Effective Date.” Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
